Honolulu Divorce Law

The Petition for Dissolution of Marriage is the initial document filed with the Hawaii court by the spouse requesting the court to terminate the marriage.  The family court shall decree a divorce in Honolulu according to the following grounds:

  • Irretrievably breakdown of marriage;
  • Living separate and apart under a decree of separation;
  • Living separate and apart for at least a period of 2 years.
  • Living separate and apart for a continuous period of at least 2 years immediately preceding the application, there is no reasonable likelihood that cohabitation will be resumed. (Hawaii Statutes - Title 580 -
    - Chapters: 41)

The divorce should be filed in the judicial district the plaintiff resides or the judicial district the spouses last lived together as a married couple. (Hawaii Statutes - Title 580 - Chapters: 1)

Every divorce case that is filed in the state of Hawaii must declare the grounds in which the divorce is to be granted.  The grounds for divorce must be substantiated with evidence or testimony otherwise the court may dismiss the case.

It is important that you completely understand the grounds and any potential legal repercussions when you are petitioning the court for a divorce, or agreeing to a divorce.  Experienced divorce attorneys in Honolulu, such as Khaled Mujtabaa can help guide your through the process.

Uncontested vs. Contested Divorce in Honolulu

Uncontested divorce in Honolulu means that neither party disputes the divorce and there are no issues to be decided by the court.  Unfortunately the majority of divorces are considered contested divorces in Honolulu, in which typically there are disagreements between the divorcing couple, such as spousal support or who should gain custody of the children.

There are various scenarios that can occur with contested divorce proceedings that attorney Khaled Mujtabaa is familiar with and can help determine which is best in your case.

There are also alternatives to arbitration which may require drawn out court proceedings.  Khaled Mujtabaa can also assist in cases of contested divorce requiring:

  • Legal Separation
  • Divorce Mediation
